This agreement contains important information regarding your legal rights, remedies, and obligations, including various limitations and exclusions on damages you may claim against CareTrigger and indemnification obligations you may owe to CareTrigger.

CareTrigger is not a medical device, medical service, emergency service, or insurance product. It is a convenience application that may assist in detecting unusual activity patterns. CareTrigger does not guarantee detection of any emergency, medical event, or dangerous situation. False positives and false negatives may occur. In the event of an emergency, always contact your local emergency services immediately.

If you are under the age of 18, you must have your parent or legal guardian read and accept these terms before using the service.

I. Introduction and Acceptance

These Terms of Service govern your access to and use of the CareTrigger mobile application, website, and all related services (collectively, the “Service” or “Services”) provided by CareTrigger Ltd. (“CareTrigger,” “Company,” “we,” “our,” or “us”). By downloading, installing, accessing, or using the Service, you signify that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms, you may not access or use the Service. We reserve the right to modify these Terms at any time. Changes will become effective no earlier than fourteen (14) days after they are posted or notice is sent, except that changes addressing new features or changes made for legal reasons may be effective immediately. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms.

II. Definitions

Abnormal Behavior
A probabilistic, algorithmically generated assessment indicating that a User’s device telemetry, geolocation, or interaction frequency has deviated by a statistically significant margin from the historically established baseline patterns computed for that User. It is not a factual declaration of danger, but a mathematical observation of data variance.
Alert
An automated digital notification—which may be delivered via push notification, SMS, phone call, third-party instant messaging services, email, or in-app indicator—dispatched to a User regarding the activity status, location, or behavioral anomaly of another User within their Pair or Group.
App Store / App Provider
Any third-party digital distribution platform through which the CareTrigger application is downloaded, updated, or accessed, including but not limited to the Apple App Store and Google Play.
Device
The smartphone, tablet, wearable, or other location-enabled digital hardware used by the User to install and run the CareTrigger application.
Group
A consensual, digitally linked network of three or more Users within the CareTrigger ecosystem who have authorized the sharing of activity data, location, and behavioral analytics among the members.
Monitee
A User whose device telemetry, geographic positioning, and behavioral patterns are tracked, analyzed, and transmitted to a designated Monitor.
Monitor
A User who has been granted permission to receive telemetry data and Alerts regarding a Monitee.
Pair
A consensual, digitally linked monitoring relationship between two Users, which may be mutual (bidirectional) or one-way (unidirectional).
SOS Alert
A manually initiated distress notification sent by a User to their designated Monitor(s) or Group members through the Service.
User / you
Any individual who downloads, installs, accesses, or uses the Service.
User Content
Any profile data, textual communication, geographic labels (e.g., designating a location as "Home" or "Work"), images, or other content uploaded, generated, or transmitted by the User within the Service.

III. Description of the Service

CareTrigger is a convenience application designed to monitor certain User activity patterns and provide Alerts when potentially Abnormal Behavior is detected. The Service includes, but is not limited to, the following features:

A. Pairs and Groups

Users may form monitoring relationships (Pairs) or multi-member monitoring arrangements (Groups), in which Users may monitor one another mutually or on a one-directional basis. The formation of any Pair or Group requires the explicit consent of all participating members.

B. Activity Monitoring

The Service collects activity data from the User’s Device, which may include step count, device interaction patterns, sensor telemetry, and other usage metrics. Users may optionally enable location data collection. This data is analyzed using artificial intelligence and machine learning algorithms to detect deviations from established behavioral patterns.

C. Alerts and Notifications

When the Service detects a potential anomaly in a Monitee’s activity pattern, it may send Alerts to the Monitor(s) through one or more channels, including but not limited to: push notifications, phone calls, SMS, third-party instant messaging services, email, or in-app notifications. The availability and reliability of these channels depends on third-party services and network conditions beyond our control.

D. Location Sharing

Users may optionally enable location sharing, allowing other members of their Pair or Group to view their real-time or last-known location and status within the Service.

E. Remote Device Access

With explicit, informed, and revocable consent, a User may grant another User within their Pair or Group the ability to remotely activate the loudspeaker, microphone, or camera on their Device. This feature is intended solely for welfare-check purposes. Consent for this feature may be withdrawn at any time through the Service’s settings.

F. SOS Alert

Users may manually initiate an SOS Alert to notify their Monitor(s) of a perceived emergency or distress situation. The SOS feature is a communication tool only and does not connect to emergency services (e.g., 911, 112, 999, or equivalent).

IV. User Roles and Responsibilities

V. Eligibility

The Service is intended for use by individuals who are at least eighteen (18) years of age or the age of majority in their jurisdiction, whichever is higher. If you are under 18 (or the applicable age of majority), you may only use the Service with the consent and under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

The Service is intended for personal, non-commercial use only and is not intended for use by entities, businesses, organizations, or institutions.

VI. Account Registration and Security

To use the Service, you must create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials, passwords, and any associated multi-factor authentication tokens, and for all activities that occur under your account. You agree to notify CareTrigger immediately of any unauthorized use of your account or any other breach of security.

VII. Consent, Permissions, and User Interactions

A. Mutual Consent

All monitoring relationships (Pairs and Groups) require the explicit, informed consent of every participating member. You may not add another person to a Pair or Group, or monitor another person’s activity, without their prior consent through the Service’s in-app consent mechanism. Covert tracking, non-consensual surveillance, and the use of the Service to facilitate abuse, stalking, or harassment constitute fundamental breaches of this Agreement.

B. Remote Device Access Consent

The remote activation of a Device’s loudspeaker, microphone, or camera requires separate, explicit, informed consent from the Device owner. This consent is granular and revocable at any time.

C. One-Way Monitoring

In configurations where a Monitee is tracked without receiving reciprocal data from the Monitor, the resulting information asymmetry presents heightened privacy considerations. The Monitor assumes all legal responsibility under applicable privacy legislation for the collection, handling, and potential misuse of the Monitee’s data.

D. Withdrawal of Consent

Any User may withdraw consent, leave a Pair or Group, disable location sharing, revoke remote device access permissions, or delete their account at any time through the Service’s settings. Withdrawal of consent will take effect as soon as technically feasible.

E. Responsibility for Use of Shared Information

CareTrigger is not responsible for how members of your Pair or Group use the information they receive about you through the Service, including your location, activity data, or any audio or video obtained through the remote access feature.

F. Lawful Use

You represent and warrant that your use of the Service, including all monitoring, location sharing, and remote device access features, complies with all applicable laws in your jurisdiction.

VIII. Prohibited Uses

You agree that you will not use the Service to:

  • Monitor, track, surveil, or access the Device of any person without their knowledge and explicit consent
  • Stalk, harass, threaten, intimidate, or abuse any person
  • Violate any applicable local, state, national, or international law or regulation
  • Infringe upon or violate the privacy rights or any other rights of any person
  • Use the remote device access feature for any purpose other than a genuine welfare check with the Device owner’s consent
  • Record, store, distribute, or share any audio or video obtained through the remote access feature without the knowledge and consent of all parties
  • Attempt to circumvent, disable, or interfere with the Service’s security features or consent mechanisms
  • Use the Service for any commercial, law enforcement, investigative, or surveillance purpose
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code or algorithmic models of the Service
  • Interfere with or disrupt the Service or servers or networks connected to the Service

Violations of this section may result in the immediate suspension or permanent termination of your account.

IX. License and Intellectual Property

Subject to your compliance with these Terms, CareTrigger grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the Service on a single Device that you own or control, for your personal, non-commercial use only. CareTrigger reserves all rights not expressly granted herein.

The Service, including all content, features, functionality, software, algorithms, machine learning models, text, images, logos, and trademarks, is and shall remain the exclusive property of CareTrigger and its licensors.

X. Mobile Software and App Store Terms

When you download the CareTrigger application from an App Store, you acknowledge and agree that: (i) these Terms are between you and CareTrigger, not with the App Provider; (ii) the App Provider has no obligation to provide maintenance, support, or warranty services; (iii) the App Provider is not responsible for addressing any claims relating to the application; and (iv) the App Provider is a third-party beneficiary of these Terms with the right to enforce them against you.

XI. Service Availability and Modifications

CareTrigger strives to maintain reliable and continuous service but does not guarantee that the Service will be available at all times or without interruption. CareTrigger reserves the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

XII. Device Impact and Data Charges

You acknowledge that the Service requires continuous or frequent background processing, sensor data collection, and data transmission, which may significantly deplete your Device’s battery life and consume substantial cellular data. CareTrigger expressly disclaims any liability for battery drain, Device hardware degradation, or any telecommunications charges incurred in connection with your use of the Service.

XIII. Billing, Pricing, and Payment

Certain features of the Service may require a paid subscription. Subscriptions are billed on a recurring basis and will automatically renew unless you cancel prior to the end of the current billing cycle. All fees are non-refundable except as expressly stated herein or as required by applicable law.

CareTrigger reserves the right to change pricing at any time, with reasonable advance notice to existing subscribers.

XIV. Cancellation and Account Deletion

You may cancel your paid subscription or delete your account at any time through the Service’s settings or by contacting our support team. Cancellation of a paid subscription will take effect at the end of the current billing period.

Important: Simply deleting or uninstalling the CareTrigger application from your Device does not constitute a cancellation of any paid subscription. Automated billing will continue until the subscription is properly cancelled.

XV. Important Disclaimers

A. Not a Medical Device

The Service is not a medical device, diagnostic tool, or healthcare service. It has not been evaluated, approved, cleared, or certified by any medical regulatory authority. The Service does not diagnose, treat, cure, mitigate, or prevent any disease or medical condition.

B. No Professional Advice

Nothing in the Service constitutes medical, health, psychological, legal, or any other form of professional advice. You should not rely on the Service as a substitute for professional judgment or emergency response.

C. Not an Emergency Service

The Service is not a replacement for emergency services. The SOS feature does not contact police, fire, ambulance, or any emergency dispatch center. In the event of an emergency, always contact your local emergency services immediately.

D. Not an Insurer or Supervisory Substitute

CareTrigger is not an insurance company, security company, or alarm monitoring service. The Service does not provide insurance coverage, guarantee personal safety, or replace professional monitoring services of any kind.

E. No Guarantee of Detection

The Service relies on artificial intelligence and machine learning to analyze User activity data, which is inherently imperfect and subject to significant limitations. CareTrigger does not guarantee that the Service will detect any particular event, emergency, anomaly, or dangerous situation. The Service will inevitably produce false positives and false negatives.

F. Assumption of Risk

By using the Service, you acknowledge and agree that CareTrigger is a supplementary convenience tool and not a safety guarantee. You assume all risks associated with reliance on the Service.

XVI. Privacy

Your privacy is important to us. Our collection, use, disclosure, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

XVII. Security

CareTrigger implements commercially reasonable technical and organizational measures to protect the security of your personal information. However, no method of transmission over the internet or method of electronic storage is completely secure.

XVIII. Third-Party Services and Links

The Service may integrate with, rely upon, or contain links to third-party services, platforms, and websites. CareTrigger does not control, endorse, or assume responsibility for any third-party services. The delivery of Alerts through third-party channels depends on those third parties and is subject to their service limitations.

XIX. Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless CareTrigger and its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees arising from or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of another person or entity; (d) your use of the monitoring, location sharing, or remote device access features; (e) any User Content you submit; or (f) any reliance you or any third party places on the Service.

XX. Disclaimer of Warranties

The Service is provided on an “as is,” “as available,” and “with all faults” basis, without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, CareTrigger disclaims all warranties, express, implied, statutory, or arising from a course of dealing, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, title, accuracy, reliability, availability, security, and timeliness.

XXI. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall CareTrigger be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or in connection with your use of the Service.

The total aggregate liability of CareTrigger for all claims shall not exceed the greater of: (i) the amount you have paid to CareTrigger in the twelve (12) months preceding the event giving rise to the claim, or (ii) one hundred US dollars (US $100.00).

XXII. Dispute Resolution

A. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which CareTrigger is incorporated, without regard to its conflict of law provisions.

B. Informal Resolution

Before initiating any formal dispute resolution process, you agree to first contact CareTrigger and attempt to resolve the dispute informally for a period of at least thirty (30) days.

C. Arbitration

Any dispute that cannot be resolved informally shall be resolved by binding arbitration in accordance with the rules of a recognized arbitral institution.

D. Class Action Waiver

To the fullest extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

E. Time Limitation on Claims

Any claim arising out of or related to the use of the Service must be filed within one (1) year after such claim arose.

XXIII. Termination

CareTrigger may terminate or suspend your access to the Service at any time, with or without cause or notice. You may terminate this Agreement at any time by deleting your account through the Service’s settings, cancelling any active subscriptions, and uninstalling the application from all Devices.

XXIV. Force Majeure

CareTrigger shall not be liable for any delay or failure in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, power outages, telecommunication failures, internet service failures, cyberattacks, or any other event beyond our reasonable control.

XXV. General Provisions

A. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices published by CareTrigger on the Service, constitute the entire agreement between you and CareTrigger regarding the Service.

B. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, the remaining provisions shall remain in full force and effect.

C. No Waiver

The failure of CareTrigger to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

D. Assignment

You may not assign or transfer these Terms without the prior written consent of CareTrigger. CareTrigger may assign these Terms without restriction.

E. Electronic Communications

By using the Service, you consent to receive all legal notices and operational communications from CareTrigger in electronic format.
